- You and TLD may enter into a sale contract for the sale and supply of goods or services described in this website, by you making an offer to TLD via this website, to purchase the goods and services at the specified price, subject to these Terms and Conditions.
- In these Terms and Conditions : –
- “you”, “user”, “member”, and “guest” means anyone who visits and/or uses this website.
- Reference to a “third party” in these Terms and Conditions includes a reference to any agent or contractor of TLD, or of any of its related entities, and any person engaged by any of them, in the creation, provision or maintenance of this website or in the fulfillment of Orders made through this website, and includes any of them.

- “Order” means a request made by you on our goods or services via this website to be supplied or delivered by us.

- Once an Order has been accepted by TLD, no cancellation of that Order is valid unless you receive our written communication permitting the cancelled Order.
- Representations of goods or services for sale made by TLD via this website do not constitute an offer to sell but an invitation to treat.

You acknowledge that :-
- The transmission of your offer or the confirmation of any payment, made through an electronic instruction may not be received by TLD for reasons beyond either parties’ reasonable control including but not limited to, electronic failure, mechanical, software, computer, or telecommunications failure, or the omission or failure of third party website providers or systems.
- To the fullest extent permitted by law, TLD is not liable to you in any way for any loss or damage of any kind, however caused, arising directly or indirectly in connection with the transmission of an electronic instruction through the website, or any failure to receive an electronic instruction for whatever reason.
- TLD may act on and process all completed electronic instructions transmitted or issued through the website without further consent from or reference to you.
- TLD may treat an electronic instruction as authentic and is under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions.
- You will receive an email or message from TLD as soon as practicable after you have confirmed your Order and made payment. If you have any questions regarding your Order you may contact our Customer Service Team. Please note this email does not constitute acceptance of your Order by us but merely confirms our receipt of your Order.
- If your Order is not accepted by TLD, TLD will notify you by telephone or email and arrange for a full refund of any payment made by you to be processed.
- TLD may, in its sole and absolute discretion, accept or reject any offer made by you for any reason (or no reason), including an error in the advertised price for, or description of, goods or services on the website, or an error of any kind in or relating to your Order.
- Any representations made at any time about stock availability are accurate to the last known stock level and are subject to change. If TLD cannot supply particular goods, TLDP will notify you by telephone or email as soon as possible.
- TLD will be deemed to have accepted your Order on the first to occur of issue to you: of a tax invoice for the sale and the fulfilment of your Order.
- With regard to any Order placed by you for any customized goods (including without limitation furniture made to or incorporating a particular design, specification, colour, configuration, pattern or fabric) TLD will e-mail you a notice of acceptance following confirmation of receipt of your Order at which point the customized goods shall be ordered by us from our suppliers.
- Upon the sending to you of the notice of acceptance, TLD shall be deemed to have accepted your offer, following which no cancellation of your Order by you shall be permitted and no refund or no exchange shall be made by us in respect of such goods.

Price
- Prices shown are in Ringgit Malaysia and include SST where applicable. Prices may not include delivery and handling charges. Prices are valid until amended or removed from this website and are subject to change at any time.
- Each published saving in respect of goods or services is by reference to the lower of the recommended retail price of the manufacturer or the normal retail price of TLD.
- Images of goods shown without any advertised price beside that image are not offered for sale.
- Unless otherwise stated, accessories shown in any image of goods are not included in the price.
- We reserve the right to correct any errors published on the website at any time.
Promotion
- All promotions running in this website are subject to each promotion’s terms and conditions.
- All promotions run independently and can’t be combined with other ongoing promotions unless otherwise stipulated.
- Each discount / voucher / promo code (if any) can only be used once per transaction per account and cannot be combined with other ongoing promotions unless otherwise stipulated.

Payment
- All payments must be made in full prior to delivery, including any applicable delivery or handling charges.

Card payments are processed through third-party payment channels and the type of credit cards/Debit Cards accepted by these payment channels may vary depending on the jurisdiction you are in. - Financial Process Exchange (FPX)
Financial Process Exchange (FPX) are processed through third-party payment channels and several banks are allow to select by using FPX. When you place an order with FPX you will be redirected to your own respective bank website. Then you need to login with your bank username and password in order to proceed the payment. FPX uses highly secured authentication, security credentials and certification standards to ensure security of all transaction.
- Credit Card/Debit Card
- To the extent permitted by law, we will not be responsible for any damages or consequential losses (whether direct or indirect) suffered by you were a bank account is fraudulently used or is used in an unauthorized manner.
- If there is a problem with your payment, we may contact you to make alternative payment arrangements. You will be liable for all debt collection costs where you fail to make payment for any order when payment is due.

Force Majeure
- TLD will not be liable for any delay in performing any of their obligations if such delay is caused by circumstances beyond their reasonable control, including but not limited to natural disaster, failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries.
Governing Law
- The courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our website or any Order placed on the website, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These Terms and Conditions are governed by Malaysia law.
Severability
- If any part of these Terms and Conditions are found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from these Terms and Conditions and the remaining terms and provisions of these Terms and Conditions will remain in force and constitute the agreement between you and TLD.
Transfer and Assignment
- If TLD merges, sells or otherwise changes control of its business or this website to a third-party, TLD reserves the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that TLD has collected from you and any agreements it has made with you.
Waiver
- The failure by TLD to exercise or enforce any right or provision under these Terms and Conditions will not constitute a waiver of such right or provision. Any waiver of any provision under these Terms and Conditions will only be effective if it is in writing and signed by TLD.
Membership Rewards
- The Membership Card (“MC”) is launched, issued and managed by TLD. The MC is only issued in digital form.
- The MC is only applicable to an individual customer. When individual customer register at this website, the individual customer will automatically become a member. As our members, members can collect point from both walk in outlet and this website purchases.
- MC points awards by the ways is : RM1 = 1 point based on the bill total amount. Members birthday’s months point award : double points based on the bill total amount.
- Point Redemption : Points can be redeemed for use in purchases at our walk in outlet or this website.
The conversion rate is: 1,000 points = RM10.00.
Minimum Redemption is a block of 1,000 points with minimum cash of RM10. - Point cannot be converted into cash or any other forms of money, regardless of the ways through which the points are earned.
- Points are not deemed as any form of property; hence they are not any property over which you may exercise the full right of possession. Point cannot be transferred to other members. TLD may, in its sole discretion, adjust the point value or amend relevant provisions relating to points redemption without your prior consent.
- You shall be responsible for your membership account, which is designated solely for your own use and cannot be transferred, given as a gift or inherited.
- Use of the MC constitutes acceptance of these Terms and Conditions. Members of the MC shall be deemed to have read and understood all the terms and conditions. EXCHANGE,RETURN AND REFUND POLICY
Exchange Policy
- This Exchange Policy is only applicable for online purchased goods at this website. Kindly submit your request exchange to enquiry@thelivingdepot.com.my.
- Exchange goods only permitted within fourteen (14) days from the date of receive the goods. No exchange will be accepted after this stated period.
- Exchange of goods may only allow for the following reasons :-
- If the goods delivered are due to manufacturing defect; or
- If the goods delivered are different or incorrect from the initial order.
- Goods for exchange shall be return and subject to the following terms and conditions :-
- The original proof of purchase must be provided;
- Goods must be in its original purchase condition, quantity and packaging as it was first delivered to you;
- Non-returnable, non-exchangeable and non-refundable goods will not be accepted.
- Goods can only be exchanged on the following goods :-
- Goods must be exchanged with the same goods and/or same price and/or same brand; and
- Goods must be of the same quantity, volume and size.
- In circumstances where there is no replacement goods immediately available. Our Customer Service Team will notify you via call or email once the goods is available and ready for collection at the Self Pick Up address.

- Goods return must be in its original purchase condition, quantity and packaging as it was first delivered to you.
- Non-returnable, non-exchangeable and non-refundable goods will not be accepted.
- Delivery charges paid in the original order are non-refundable.
- The refund amount will deduct the coupon discount/voucher discount amount (if any) and/or bank charges for the online transfer/credit cards or debit cards charges (if any), and the coupon/voucher will not be reissued.
- Customer requires to return the manufacturing defect or wrong goods to TLD outlet (which located at the following address) (“Return Address”) within three (3) days upon receiving confirmation from our Customer Service Team.
- Upon receipt and inspection of the return goods, we’ll confirm its arrival via email and inform you of approval or denial of the refund.
- There will be no refund in cash through outlet cashier. The refund will be allowed via the same mode of payment via online.
- For example : If the mode of payment is through member points and credit card/debit card, the refund will be made through member points and credit card/debit card.

Return Policy
Unfortunately, we cannot offer a return, exchange and refund on the following goods :-
- Cement or cementitious products
- Construction steel bars or industrial metal products
- Timber and related products
- Selected shelf-life products
- Special order or custom-made products
- Any products specifically cut to size at your request
- Tinted paint or special mixed paint
- Any goods bought in bulk/commercial quantity
- Products sold at mark down prices due to defect
“Non-returnable, non-exchangeable and non-refundable goods” (“NRERG”) means for those goods listed under the Exceptions clause above and/or those goods is remark as NRERG in the product description of this website. The customer are advised to think twice before place an order for those goods remark as “NRERG” due to non-returnable, non-exchangeable and non-refundable.
The customer shall bear their own cost to return the goods to the Return Address (stated in Clause 4 (a) hereto) for return or exchange or refund. The customer shall be responsible for the risks and conditions of the goods to be returned until it reach the Return Address. TLD will not be liable for any loss or damage to the goods prior to the goods are received by us. The customers are advised to pack the goods safely to prevent any loss or damage to the goods or its original box or packaging.

SHIPPING POLICY
Thank you for shopping with The Living Depot (“TLD”). Below are the details regarding our shipping policy:-
Shipping Method
Together with our strong shipping partner, Easy Parcel provide reliable and short time delivery within Peninsular Malaysia.
Shipping Costs
Shipping costs are calculated based on various factors including the shipping method selected, the destination of the package, and the weight/size of the items ordered.
Shipping Time
- Orders are typically processed within seven (7) working days of purchase subject to the stock availability. Once processed, delivery times vary depending on the shipping method chosen and the destination.
- Any customized goods which are not held in stock will be required to be ordered. You agree that your Order for any customized goods may take up to X (X) weeks to be delivered to you from the date you placed your Order. This time frame is the average manufacturing lead time required by suppliers. TLD will contact you on receipt of your Order to notify you of the indicative delivery date.
- Delivery dates are estimates only and we are unable to accept any liability for failure to deliver the goods within the specified time resulting from shipment or delivery delays from our suppliers.
- Other than in respect of Orders for any customized goods, if TLD gives you notice that it will be unable to deliver your Order within seven (7) working days or X weeks from the date of receipt of your Order, due to no stock availability, you may cancel your Order without charge, and TLD will arrange for a full refund of any payment made by you to be processed.
- If you order large or bulky items, TLD will contact you by telephone or email to arrange with you a suitable time for delivery. In the event that the said large or bulky items is not able to deliver by our courier partner, we will using our own transport which may create an extra delivery or transportation fees depending on the weight and size of the items and the delivery destination. You may requires to bear the extra delivery or transportation fees.
- If you wish to change the delivery date or delivery address you shall contact our Customer Service Team within 24 hours from the date you have placed your Order.
- You must advise at the time you place your Order via the website or later when you discuss delivery with TLD, of any difficulties that may be involved in the delivery (such as stairs or narrow entries). If you do not state the situation correctly and on arrival the delivery contractor deems it to be a difficult location you will be liable for any extra charges including redeliver fees and the cost of an extra person to assist.
- If you reside in a condominium or apartment, kindly notify the management and security personnel regarding delivery details, including the expected arrival time, the courier service’s name, and whether you prefer the items to be left at the management office or security guard station.
- No installation services provided for Orders fulfilled by us or our third party delivery contractor.
- You are required to inspect your goods when you are receiving the goods from our appointed courier service or delivery contractor. You will be required to note any damage on the delivery documentation which is presented to you by the courier service or delivery contractor for signature. In all other cases you will be required to notify us in writing of any damage on delivery or shortages within seven (7) days of delivery. We will not be liable for any damage on delivery to any of the goods unless we are notified within the time period specified above.
Tracking Orders
Once your order has been shipped, you will receive a tracking number via email. This allows you to monitor the status and location of your goods.
International Shipping
For now, we only make deliveries within Peninsular Malaysia. Additional charges and longer delivery times may apply for the destination other than Selangor orders.
Shipping Restrictions
Please note that some goods may be restricted from shipping to certain locations due to legal restrictions or logistical constraints.
Shipping Address:
- It is the responsibility of the customer to provide accurate shipping information. TLD is not liable for orders shipped to incorrect addresses provided by the customer.
- Shipping address must be an address within Peninsular Malaysia and cannot be a freight forwarding location. Deliveries cannot be made to certain rural areas and islands like Pulau Langkawi, FELDA etc. Please contact our Customer Service Team for details.
Shipping Delays:
While we make every effort to ensure timely delivery of your order, please be aware that shipping delays may occur due to factors beyond our control, such as weather conditions, holidays, or carrier delays.

Self Pick Up
- Please allow five (5) to seven (7) working days to process the order. We will contact you once the order is ready. You are only allow to pick up your order at our following TLD outlet. No shipping charges for self pick up.

- Self pick up orders must be collected within seven (7) days from the above Self pick up address after our Customer Service Team has giving you notice by telephone or by email that your Order is available for collection. If your Order do not collected within this time, TLD has the right to allocate those goods to another customer and reorder the goods for you.
- The person who collects the goods must provide the order confirmation print out, photo identification and present the credit card or payment receipt used for the online transaction. If the person is unable to collect the order in-store personally, the person must contact our Customer Service Team to notify us of the name of the person nominated to collect the order on behalf.
- Please allow five (5) to seven (7) working days to process the order. We will contact you once the order is ready. You are only allow to pick up your order at our following TLD outlet. No shipping charges for self pick up.
